Welcome to the official photo-sharing platform for the Saifee Marathon (“the Event”). By accessing, viewing, or downloading any photos on this website (“the Platform”), you agree to comply with and be bound by these Terms of Service (“Terms”). Please read them carefully before proceeding.

1. Ownership and Copyright

1.1. All photos on this Platform were taken during the Saifee Marathon and are owned by or licensed to the Saifee Marathon Organizing Committee (“the Organizers”).
1.2. The photos are protected under Tanzanian copyright laws and international treaties.
1.3. You are granted a personal, non-commercial license to view, download, and share photos only for private use or personal social media sharing.
1.4. You may not sell, alter, reproduce, or use these images for commercial purposes without prior written consent from the Organizers.

2. Participant Consent and Privacy

2.1. By participating in the Event, participants were informed that photographs and videos would be taken for documentation and promotional purposes.
2.2. The Organizers have taken reasonable measures to comply with the Tanzania Personal Data Protection Act, 2022 (PDPA), ensuring that personal data—including identifiable images—is processed lawfully and securely.
2.3. If you appear in any photograph and do not wish your image to be displayed publicly, you may request removal by contacting us at dpo@saifeehospital.co.tz We will take reasonable steps to review and act on your request in accordance with PDPA obligations.

3. Acceptable Use

3.1. You agree not to:

• Misuse, alter, or distort any image in a way that could harm the dignity, reputation, or privacy of any individual;

• Use any photo for discriminatory, defamatory, illegal, or offensive purposes;

• Attempt to collect, extract, or use metadata or biometric information from any image.

3.2. The Organizers reserve the right to restrict or revoke access to the Platform if misuse is detected.

4. Data Collection and Cookies

4.1. The Platform may collect limited technical data (such as IP addresses, device information, and browsing statistics) for security and usage monitoring.
4.2. Any personal data collected will be handled in compliance with the PDPA and used only for the purpose of administering and improving the Platform.

5. Disclaimer and Limitation of Liability

5.1. The Organizers make no guarantees regarding the availability, accuracy, or quality of the photos.
5.2. Access to the Platform is provided “as is” and at your own risk.
5.3. The Organizers are not liable for any loss, damage, or misuse arising from the download, distribution, or unauthorized use of the photos by third parties.

6. Changes to These Terms

6.1. The Organizers may update these Terms from time to time to reflect legal or operational changes.
6.2. Continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tanzania.
